1 TERMS AND CONDITIONS

These terms and conditions constitute a legally binding agreement being entered into between The Veterans Competitions Ltd a company with its registered office at Brook House Church Lane, Garforth, Leeds, England, LS25 1HB (Promoter) and the person entering a competition. By entering a competition, you agree to the terms and conditions set out below.

2 THE COMPETITION

We run several different competitions at any one time. You can choose which competition you wish to enter by selecting these from our website www.theveteranscompetition.co.uk. Information about our competitions can also be found on our Facebook page “The Veterans Competitions” at on our Facebook page.

3 ENTERING A COMPETITION

3.1 You can enter a competition online by completing the entry form and answering the question appearing on the Website when you enter. For the avoidance of doubt by answering the question which appears on the Website you acknowledge that when answering the question, you must exercise reasonable skill and judgement. By entering this competition, you agree to be bound by these Terms and Conditions.

3.2 Online entries are charged at the cost of the ticket. The price of tickets may vary depending on the Competition entered by you. The entry fee (Fee) for a competition will be determined by us and detailed on the Website or Facebook page for each competition. The entry fee is inclusive of VAT.

3.3 To enter an online competition, you need to create a user account by signing up on our Website.

3.4 When you create an account, you must provide your Personal Data, which includes your name, address, email address, and telephone number. By submitting your entry, you confirm your consent to our use of your Personal Data for the purposes of the competition. You can find out more about our use of your Personal Data1 by clicking here. You must keep your user account details confidential and secure and not share these with anyone.

Personal Data is as defined in data protection laws and includes any information from which a living Individual can be identified such as name, address, telephone number, images, photographs.

3.5 You will receive an automatic email from us when your account has been created.

3.6 Once your account has been created you can use it to enter our competitions by purchasing tickets. Once you have made payment for your ticket(s) you will receive a payment confirmation from us and a purchasing ticket number which purchasing ticket number will be entered into the prize draw.

3.7 You may enter a competition up to £100.00 per user account. You cannot spend more than £100.00 per competition. Entries over the maximum limit will be void. Any caps on competition entries may be updated from time to time by us at our discretion. You should check entries on the Website for any caps on the number of entries for the competition you wish to enter.

3.8 By submitting your entry, you confirm that you have read and understood these terms and conditions and agree to be bound by them.

3.9 Free Entry: all free entry competitions can be entered via postal entry and must meet the criteria listed below. Entries via post MUST be entered on a postcard showing a similar item advertised in the draw, for example: Prize of a car, the postcard must have a car within the picture, if it’s a watch a picture of a watch etc. You must include your personal details on the postcard, including your name, address, DOB and contact phone number to enable us to contact you if you’re selected as the winner. Your entry must also include the correct answer to the displayed question for that competition. All postal entries must be received 7 days before the live draw. If all the requirements for free postal entry are not met, then the postal entry will be void. We cannot be held responsible for any postal delays or the loss of any entries through the postal system. We will not use your personal details in any other way, other than for the entry of the competition.

4 START DATE

The start date of each competition will be as advertised on our Website and Facebook page.

5 CLOSING DATE

5.1 We select winners through live draws and the closing date for entries to a competition will also be specified on our Website. Entries received by us after this time (whether or not they were sent before) will be void, non-refundable, and will not be entered into the competition.

5.2 Each of our competitions will have a limited number of tickets. If all tickets for a particular competition are sold out before a live draw, the live draw may be brought forward to an earlier live draw date. We will notify you on our Website and Facebook page if a live draw date has been brought forward.

5.3 If we have not sold enough tickets for a live draw, the date of the live draw will be extended at our discretion.

5.4 The winner will be selected as soon as possible after the closing date. However, please note that the closing date may be extended by us at our sole discretion where insufficient tickets have been sold.

6 ELIGIBILITY

6.1 To enter our competition, you must be a resident of the UK and be aged 18 or over at the time of entry.

6.2 The following persons are not eligible to enter:

6.2.1 Our associates, relatives, family, and those with a direct or indirect connection to the development, operation, conduct or administration of the Website and or a competition.

6.2.2 Our employees or workers;

6.2.3 Employees or workers of any organisation involved in the operation or administration of this competition including prize suppliers and advertising agencies, and members of their immediate families.

6.2.4 Our decision on who is not eligible to enter shall be final.

6.3 If you are entering this competition where the prize is a vehicle you must have a valid driving license and insurance. If you are entering a competition where a prize is a holiday or requires you to travel you must ensure that you are eligible to travel and have a valid passport, visa, and holiday insurance. You should check the Website for any specific eligibility criteria that may be applicable to a competition as these may be updated or vary from time to time depending on the competition.

6.4 Entries will be void if they:

6.4.1 do not comply with these terms and conditions:

6.4.2 are incomplete:

6.4.3 are submitted in bulk (for example, more than one entry per four-hour period) or multiple entries to purchase all tickets by one person.

6.4.4 are considered by us to be part of an attempt to manipulate or unfairly influence the outcome of a competition.

6.5 We may ask for proof of age, residence, eligibility, or proof of purchase of a ticket for entry to a competition (i.e electronic receipt). Delay or failure to provide the evidence to our reasonable satisfaction may result in an entry being void or a prize being forfeited.

6.6 Our decision as to whether you (or your entry) are eligible for this competition is final and we are not obliged to provide any reasons for disqualification.

7 SELECTION OF THE WINNER

7.1 The number of winners for each competition shall be advertised on our Website and our Facebook Page.

7.2 The winner of this competition shall be the number of the holder of the ticket number selected randomly during a live draw by the independent number generator. The number selected by the independent number generator is the final winning number.

8 PRIZE

8.1 Prizes will vary from competition to competition and depending on the prize, will be supplied by one of our suppliers such as a car dealership or a travel agency.

8.2 The winner is responsible for any costs or expenses involved in claiming or using the prize other than those that are expressly stated above as being included as part of the prize.

8.3 The prize may be subject to additional terms and conditions imposed by the supplier or other organisation connected to this competition.

8.4 If necessary due to circumstances beyond our control, we may (at our option) substitute the prize for:

8.4.1 a reasonable equivalent of equal or higher value; or

8.4.2 If the minimum tickets sales are not met. a cash alternative comprising of 75% of the tickets sold minus VAT and administrative charges will be made available for the competition the winner entered.

8.5 The prize is for the named winner only and cannot be given or transferred to any other person.

9 CONTACTING THE WINNER

9.1 We will notify the winner as soon as possible on or after the closing date (or the date of selecting a winner, if different) using the contact details provided in the entry.

9.2 Reasonable efforts will be made to contact a winner over a period of four weeks. If it has not been possible to contact the winner in that time, the prize will be redrawn to select another eligible entrant.

10 RECEIVING THE PRIZE

10.1 We will provide the winner with instructions on how to book or obtain their prize.

10.2 We are not liable for any damage or loss to a prize caused by any third party. If a prize is damaged or fails to be delivered, we have no obligation to provide a replacement prize.

11 PUBLICITY

11.1 The first name and photograph of the winner will be published on our Website and on our Facebook Page after the closing date.

11.2 If you do not want your name included on the list of winners referred to above, you must notify us within a reasonable period before the closing date of this competition. See clause 15 below for our contact details. However, we reserve the right to publish the fact that the prize has been won by a male/female candidate and to name their county.

11.3 The winner of this competition may be asked to participate in publicity and may do so if they wish to.

12 INTELLECTUAL PROPERTY

12.1 You confirm photographs, video footage, and images of you that you are agreeable to us using, for the purposes of this competition and provide your consent. You confirm that we may use your
photographs and images in any promotions and publicity. If you do not agree to our use of your photographs or images for publicity, then please email us at info@theveteranscompetitions.co.uk.

12.2 You are not entitled to any fees for granting the licence to use your photographs and images and you are not entitled to terminate it unless we agree in writing.

13 DATA PROTECTION

13.1 Your privacy and personal information are important to us. Our Privacy Policy is available at https://www.theveteranscompetitions.co.uk/privacy-policy/

13.2 Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

13.3 From time to time and only if you consent to our so doing below, we may share your data with the Soldiers Sailor and Armed Forces Families Association (SSAFA) for them to be able to provide you with their marketing information.

13.4 In accepting these terms and conditions you are providing consent to us to use your Personal Data for the purposes of entering you in a Competition.

14 OUR LIABILITY

14.1 The extent of our liability under or in connection with this Agreement (regardless of whether such liability arises in tort, contract or in any other way and whether or not caused by negligence or misrepresentation) shall be as set out in this clause.

14.2 Our liability to you shall not exceed the sum of the ticket price paid by you to us for entering a competition. We shall have no liability to you for any consequential, indirect, or special loss and we shall not be liable for the following: loss of profit, loss of contract; loss of opportunity; loss of savings, discount, or rebate (whether actual or anticipated); harm to reputation or loss of goodwill.

14.3 Except as expressly stated in this Agreement, all warranties, and conditions whether express or implied by statute, common law or otherwise are excluded to the extent permitted by law.

14.4 Notwithstanding any other provision of this Agreement, the liability of the parties shall not be limited in any way in respect of the following:

14.4.1 death or personal injury caused by negligence;

14.4.2 fraud or fraudulent misrepresentation;

14.4.3 any other losses which cannot be excluded or limited by law.

15 COMPLAINTS AND DISPUTES

16 FORCE MAJEURE

We will not be held liable for any failure or delay in the performance of our obligations under these terms and conditions for any events beyond our reasonable control, such as but not limited to an act of God, acts of terrorism, pandemic restrictions. We will keep you promptly notified of the failure or delay in delivering the prize and when we expect to be able to deliver the prize.

17 CLAIMING PRIZE FROM COMPETITION

By entering a competition, you agree to be responsible for your own costs which you may incur when claiming your prize such as expenses to travel to and collect the prize and all insurances required on
the prize.

18 RECEIVING THE PRIZE

18.1 Where the prize is capable of physical delivery at our discretion and subject to clause 16, we will within our reasonable control try to ensure you receive your prize within 30 days of being notified that you are the winner.

18.2 In instances where this is not possible the Promoter will provide instructions on how to obtain their prize.

18.3 Where it is not possible for us to deliver the prize and you need to collect it, we shall provide you with collection instructions.

18.4 We shall not be liable for any damage or loss to a prize caused by any third party. If a prize is damaged or fails to be delivered, we have no obligation to provide a replacement prize. Any damage to a prize must be raised with the supplier or the manufacturer of the product.

19 IDENTITY VERIFICATION

19.1 We are required to verify your identity before transferring a prize. You may be required to produce, prior to receiving your prize, proof of identity such as a valid passport or driving license and the valid debit/credit card you used to purchase a ticket(s) for the competition in question subject to clause 19.2.

19.2 If you have purchased a winning ticket using somebody else’s credit/debit card, you will be automatically disqualified. In the event any fraudulent activities or criminal offences are carried out in the purchase of a ticket for our competitions, you shall be automatically disqualified.

20 GOVERNING LAW

These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes shall be subject to the non-exclusive jurisdiction of the English courts.
